The Senior Regulatory and Compliance Counsel enhances the compliance and consumer protection environment through the accurate interpretation and timely implementation of complex federal and state statutes, regulations, and industry policies applicable to Nelnet Business Solutions’ (NBS’) various areas of business. In addition, Counsel collaborates with the entire Compliance & Risk Team, Leadership in Nelnet Payment Services (NPS), as well as Nelnet Legal Services, Enterprise Compliance, and Enterprise Risk Management. This position also manages relationships with NBS and NPS partners, including card brands, processors, and other critical relationships, as well as develops creative solutions to comply with applicable laws and regulations while achieving strategic objectives and competitive advantages.

JOB RESPONSIBILITIES:

  1. Remain current with all legal, regulatory, and policy issues pertaining to the various lines of business within NBS, including but not limited to privacy, Truth in Lending Act (TILA), Federal Regulation E, money services business (MSB).

  2. Build and maintain familiarity with card brand and Automated Clearing House (ACH) regulations.

  3. Communicate NBS’ compliance positions to government agencies and other regulatory authorities.

  4. Analyze, summarize, and make recommendations for internal or external reports concerning NBS.

  5. Create analytical write ups for internal review.

  6. Represent NBS in various industry associations on matters related to compliance development and standardized industry processes and forms.

  7. Review and approve marketing collateral and publicly distributed documents and presentations for accuracy relating to compliance.

  8. Manage contract reviews and interpretation, including negotiations for client changes requested for payments contracts.

  9. Participate in product reviews to ensure legal and regulatory compliance.

  10. Interpret existing and proposed applicable federal and state statutes, regulations, and sub-regulatory guidance, and coordinate with NBS management and multiple departments to ensure direct and consistent interpretations and compliant applications of federal and state laws, regulations, and policies, while maximizing consumer protection.

  11. Provide management reporting on proposed laws and updated interpretations of existing laws.

  12. Manage timely implementation of regulatory guidance and report the implementation status to NBS’s management.

  13. Provide internal training support on compliance, consumer protection, and other related issues as needed.

  14. Participate within project teams for purposes of aiding in the development of compliance procedures, forms, system specifications, and corporate policies.

  15. Develop and foster relationships with applicable government and industry personnel.

  16. Communicate NBS’ compliance positions to government agencies and other regulatory authorities. Represent NBS in various industry associations on matters related to compliance development and standardized industry processes and forms.

Salary Range: $100,000 - $120,000

EDUCATION:

  1. 4-year degree in Business, English, Political Science or Law.

  2. Juris Doctorate Degree.

  3. State license(s) preferred.

EXPERIENCE:

  1. 5 years of experience preferred in corporate compliance, a law firm, or public company, with at least 3 years devoted to interpreting and analyzing consumer or educational lending laws and regulations.

  2. Additional equivalent education above the required minimum may substitute for the required level of experience.

  1. Excellent written and oral communication (including presentation) skills with a proven ability to communicate complicated policies and procedures in an understandable manner to both internal and external clients and other industry participants.

  2. Ability to be assertive and resilient in ambiguous and controversial situations in order to lead, persuade, and influence others in accepting policy positions beneficial to NBS.

  3. Excellent time management and organizational skills with the ability to work on multiple projects simultaneously and prioritize appropriately.

  4. Excellent judgment and strategic thinking with strong analytical skills.

  5. Strong interpersonal skills including leadership, diplomacy, and negotiation.

  6. Ability to work independently in an unstructured and dynamic environment.

  7. Strong understanding of consumer protection laws preferred, including but not limited to: Regulation E (Electronic Funds Transfer Act), Regulation B (Equal Credit Opportunity Act), Regulation Z (Truth in Lending Act), Fair Credit Reporting Act (FCRA), Electronic Signatures Act (E-SIGN), Telephone Consumer Protection Act (TCPA), the Servicemembers Civil Relief Act (SCRA), and Unfair, Deceptive or Abusive Acts or Practices (UDAAP’s), and bankruptcy laws.

  8. Knowledge of NBS’ internal operational systems and procedures, preferred.
