Reference #: 4393023 THE POSITION The Pennsylvania Office of Open Records (OOR) is seeking an experienced attorney to provide responsible non-supervisory professional legal work, ranging from moderately difficult to complex, under the authority of the Pennsylvania OOR. Work involves personal responsibility and accountability for difficult and important legal matters within the agency. You will function independently, and your work is subject to general supervision by higher-level attorneys and the executive staff.

DESCRIPTION OF WORK As part of this position, your main responsibility will be to handle administrative appeals that are filed under Pennsylvania's Right-to-Know Law (RTKL). This will involve conducting thorough legal research and writing on various legal issues, ranging from moderately complex to highly complex matters, which directly impact the public's right to access government records. You will also be required to engage in discussions with both private citizens and agency representatives, addressing their concerns and inquiries related to administrative appeals. This may involve providing procedural guidance, clarifying arguments presented by the parties involved, and developing a factual record. Additionally, you will be responsible for conducting quasi-judicial hearings and reviewing documents in camera when necessary.

Another aspect of your role will involve assisting with legal-related inquiries from agencies, public officials, employees, and private citizens regarding the RTKL. This will require you to provide guidance and opinions on the impact of proposed legislation, rules, and regulations pertaining to the RTKL. Furthermore, you will be expected to undertake various related tasks as needed, such as supporting the OOR's mediation program, responding to RTKL requests submitted to the OOR, drafting legal documents, and representing the OOR before state appellate courts and courts of common pleas.

To excel in this position, it is essential that you possess a strong knowledge of common law as well as state and federal laws, particularly those related to the general administrative and regulatory functions of state government. Familiarity with judicial procedures and the rules of evidence is also crucial. Additionally, you should be well-versed in the principles, methods, materials, and practices of legal research. Your ability to effectively navigate these areas of expertise will be instrumental in fulfilling the responsibilities of this role and ensuring the proper adjudication of administrative appeals under the RTKL.

Work Schedule and Additional Information:

Full-time employment Work hours are 8:30 AM to 5:00 PM, Monday - Friday, with 60-minute lunch. Telework: You may have the opportunity to work from home (telework) part-time. This is a hybrid remote position working in Harrisburg 1-2 days a week. In order to telework, you must have a securely configured high-speed internet connection. If you are unable to telework, you will have the option to report to the headquarters office in Harrisburg. Salary:In some cases, the starting salary may be non-negotiable. QUALIFICATIONS Minimum Experience and Training Requirements: Five years of professional legal experience and graduation from an accredited school of law; or An equivalent combination of experience and training.

Post Employment Requirement: Applicants must be certified for admission to the Bar of t e Supreme Court of Pennsylvania and must maintain membership on a continuous basis during employment. Additional Requirements: You must reside in Pennsylvania; Harrisburg area is strongly preferred. Preferred Qualifications (not required): Two years of judicial clerking experience handling progressively complex matters. The successful candidate will have demonstrated: (1) excellent writing skills administered in a tight timeline; (2) demonstrated capability for legal research, analysis and reasoning; (3) an ability to handle multiple intricate legal cases at one time; and (4) general familiarity of administrative and regulatory functions of state government, judicial procedures, and the rules of evidence.
