As IP Counsel you will provide IP legal advice to the Imaging portion of the Advanced Staining and Imaging business unit and the Artificial Intelligence / Machine Learning strategic business unit (BUs) with a particular emphasis on digital pathology, imaging technology, software, and artificial intelligence in the cancer diagnostic industry. This position will work directly with engineers, scientists, marketers, and others involved in research and product development on IP matters as well as sales and the global Leica Biosystems IP/Legal Team. The IP Counsel will provide IP legal advice in all areas of IP, including IP portfolio development & maintenance and the IP aspects of agreements (such as partnerships, JVs, licensing agreements, etc.) With a strong foundation in software and hardware related IP, this is an excellent opportunity to grow your career in the medical device industry.
Serves as trusted legal counsel on all IP issues (with a particular focus on invention harvesting, IP portfolio development & management, IP training, patent preparation & prosecution, freedom to operate, landscape searches, trademarks, trade secrets, and copyrights), locally and globally, by providing solid, timely, proactive, cost effective, and practical IP legal advice.
Builds and maintains a comprehensive understanding of Leica Biosystems’ IP, products and businesses, its goals and challenges, and identifies and successfully executes appropriate IP strategies to achieve those goals and minimize those challenges.
Manages outside counsel and prepares and prosecutes patent applications with a focus on quality, output, and cost across various countries related to cancer diagnostic technologies, including digital pathology, medical imaging, and artificial intelligence software.
Drafts and negotiates IP-related aspects of agreements (e.g., licensing agreements, master service agreements, SDKs, EULAs, collaboration agreements, tech transfer agreements, NDAs, M&A, etc.).
Willing to work on the smallest and simplest, as well as the most complex, IP matters.
Juris Doctor with active bar admission in good standing in at least one US jurisdiction.
Registered to practice before the USPTO.
Bachelor’s Degree in Computer Science, Engineering (Electrical, Computer, Biomedical), or related field equivalent.
5-8 years post-bar admission in a law firm and/or in-house experience with hands-on experience drafting, prosecuting, and managing US and international patent applications directed to imaging, software, and hardware devices.
Experience counseling clients on patentability, patent infringement, patent validity matters, freedom to operate, landscape searches, invention harvesting, portfolio development & management, trademark, trade secret, and copyright matters.
Experience drafting, negotiating, and conducting due diligence for the IP aspects of agreements (e.g., licensing agreements, master service agreements, collaboration/partnership agreements, tech transfer agreements, NDAs, JVs, M&A agreements, etc.).
Highly collaborative and demonstrated success in giving practical, timely, proactive, pragmatic, cost-effective, and straightforward legal advice to clients in a collaborative environment.
Travel: Approximately 15% travel Domestic and infrequent International travel. Subject to adjustment dependent on company travel policy post COIVD-19 pandemic.
